1. Acceptance of these terms
By using this website, submitting an enquiry or confirming an order with Palette of Desserts, you agree to these Terms & Conditions. If you do not agree, please do not use the website or place an order. You must be at least 18 years old, or act with the involvement of a parent or legal guardian, to place an order.
2. Website information and acceptable use
Website descriptions, menus, photographs, availability and prices are provided for general guidance and may change. You must not misuse the website, interfere with its operation, attempt unauthorised access, submit unlawful content, or reproduce our original branding, photographs or written material without permission.
3. Enquiries and order confirmation
Submitting the booking form or sending a message is an enquiry, not automatic acceptance. An order is confirmed only after we have accepted the requested design, date and pickup details and communicated any required advance payment.
- Please provide complete and accurate contact, design, serving-size, date and studio-pickup information.
- Availability depends on capacity, ingredients and notice. We may decline a request we cannot safely or reasonably fulfil.
- Changes requested after confirmation are subject to feasibility, revised pricing and additional time.
4. Handmade products, designs and allergens
Every item is handmade. Minor variations in colour, placement, finish, size and appearance are natural and do not by themselves mean a product is defective. Reference photographs communicate inspiration; an exact copy is not guaranteed, particularly where another creator’s work, unavailable materials or seasonal ingredients are involved.
All our cakes and desserts are 100% eggless. Our kitchen handles other common allergens, which may include milk, gluten, nuts, peanuts and soy. We cannot guarantee an allergen-free environment or absence of cross-contact with these allergens. Customers must disclose allergies before confirmation and are responsible for communicating relevant allergen information to anyone consuming the product. We may refuse an order where we cannot meet a dietary request safely.
Decorative toppers, dowels, wires or supports may not be edible and must be removed before serving. Customers are responsible for supervising children and checking decorations before consumption.
5. Pricing and payment
A quotation is based on the information supplied and may change if the design, size, ingredients, urgency or other requirements change. Unless stated otherwise, applicable taxes are additional.
We may require an advance or full payment to reserve a date. The order is not secured until the required payment is received. Payment instructions will be shared directly; this website does not process online card payments. Customers should retain their payment confirmation.
6. Changes, cancellation and refunds
Custom cakes involve advance planning and perishable materials. Contact us as early as possible if you need a change or cancellation. Whether an advance is refundable depends on notice given, work already completed, ingredients or decorations purchased, and the nature of the order. Custom materials and work already performed may be deducted.
Orders cancelled very close to the fulfilment date, missed collections, or cancellations after production has begun may be non-refundable. If we must cancel because we cannot fulfil the order, amounts paid for the unfulfilled item will be refunded. Nothing in this section limits rights that cannot lawfully be excluded under applicable consumer law.
7. Studio pickup and cake care
All orders are available only for studio pickup at the agreed date and time. We do not provide delivery. Please arrive within the confirmed pickup window or contact us promptly if you are delayed.
Responsibility for safe transport and storage passes to the customer on collection. Cakes should be carried level, kept away from heat and direct sunlight, and stored according to instructions. We are not responsible for damage caused by improper handling, transport, storage, display conditions or delay after handover.
8. Quality concerns
Please inspect the product at handover where practical. If there is a genuine quality or order issue, notify us promptly—preferably the same day—with your order details and clear photographs. Because products are perishable, delayed complaints or products that have been substantially consumed may be difficult to assess. Any appropriate remedy will depend on the circumstances and applicable law.
9. Liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for delays and failures caused by events beyond reasonable control. Our total liability relating to an order will not exceed the amount paid for the affected product. These limitations do not apply where liability cannot legally be limited, including for fraud or other rights protected by applicable law.
10. Governing law and changes
These terms are governed by the laws of India. Courts having appropriate jurisdiction in Uttarakhand will have jurisdiction, subject to any mandatory consumer forum or dispute-resolution rights. We may revise these terms; updated terms apply from the date posted and do not retrospectively alter an already confirmed order unless agreed or required by law.
